Stop Garnishments
Garnishments can be stopped.
Everybody gets into a tough financial situation at one time or another. But that doesn't mean a creditor should be able to take money out of your paycheck or bank account and prevent you from paying your other bills.
If you are facing a wage or bank garnishment — or if you just had your paycheck or bank account garnished — there is only one way that is legally guaranteed to stop it: filing a bankruptcy petition.
No matter what your overall financial situation is, you can immediately stop a garnishment by filing bankruptcy. Not only that, but if you were recently garnished, filing bankruptcy will likely force the creditor to return the garnished funds.
In many circumstances you can file a Chapter 7 case that stops the garnishment and gets rid of the underlying credit card or tax debt forever. This means a complete fresh start — no more payments and no more harassing phone calls from any creditor.
If you don't qualify for a Chapter 7 (because your income is too high, or because you received a Chapter 7 discharge within the past eight years), you can still file a Chapter 13, which will stop the garnishment and allow you to pay some or all of the debt over a period of five years — with monthly payments you can afford, on your terms.
In some cases you can also use a Chapter 13 to “run out the clock” on an old judgment — by making some Chapter 13 payments and then, when the time is right, dismissing the Chapter 13 and, when you are eligible, re-filing a Chapter 7 for a complete discharge.
No matter your situation, filing bankruptcy gives you the breathing room you need by immediately stopping the garnishment, along with any other collection activity.
